1) Scope
These regulations apply to orders placed through our online shop. If you a consumer within the meaning of the Consumer Protection Act (KSchG), the provisions of FAGG no statutory right of withdrawal for B2B transactions (businesses in ↔ businesses in) .
2) Right of withdrawal (only for consumers, not for B2B)
For non-customized standard goods (e.g., accessories such as clips, protective corners, foils, paper), consumers have a 14-day right of withdrawal without giving any reason. This period begins as soon as you or a third party designated by you (not the carrier) has received the goods.
Exercise:
To exercise your right of withdrawal, simply send a clear statement by email or letter to the above address. You may use the attached sample withdrawal form , but this not mandatory .
Repayment:
We will refund all payments, including standard delivery costs , promptly and no later than 14 days from receipt of your cancellation notice. We may refuse to refund until we have received the goods back or you have provided proof that you have returned the goods, whichever is earlier.
Return costs:
You will bear the direct cost of returning the goods , provided we have informed you of this (this notice fulfills this obligation). If we have not informed you correctly, we the return shipping costs.
Replacement value:
for any loss of value of the goods resulting from handling that not necessary (e.g. obvious signs of use).
3) No right of withdrawal for customized products
no right of withdrawal according to customer specifications or clearly tailored to personal needs (our core business: e.g., menus, menu boards, hotel folders, invoice folders with printing/embossing/embroidery/logo/design) . This legal exception also applies to goods that are clearly personalized.
Note: Even if there is no right of withdrawal, statutory warranty rights (see section 4) remain unaffected.
4) Legal warranty (defects)
Regardless of the right of withdrawal, consumers are entitled to the statutory warranty rights . For goods (movable property), the warranty period is generally two years one year under certain conditions also apply to customized products.
Procedure in case of defects:
Please report any defects immediately upon discovery and describe them, ideally with photos. We will examine your claim and, in accordance with the statutory provisions, provide repair, replacement, price reduction , or replacement .
5) Return process (for cancellations and returns by arrangement)
Declare cancellation (only consumers & non-customized goods) or submit a return request.
Pack goods ; use original packaging if possible.

We cannot accept shipments that are not prepaid .
Please include an order number and contact details so we can identify the return.
6) Transport & transport damage
Please inspect shipments upon delivery. Any visible transport damage must be reported immediately in writing . Your statutory rights remain unaffected.
7) Voluntary returns outside the right of withdrawal (goodwill)
for customized products. In individual cases, we may goodwill solutions (e.g., repairs). Please contact us – we will work together to find a fair solution.
8) Online dispute resolution
Consumers have the option of submitting complaints to the EU's ODR platform . (We link to the platform in our Legal Notice/Terms and Conditions in accordance with legal requirements.)
9) Applicable law & jurisdiction
Austrian law applies, excluding the conflict of law provisions and the UN Convention on Contracts for the International Sale of Goods.
For consumers, mandatory consumer protection regulations and the statutory places of jurisdiction . For B2B transactions, the parties agree – to the extent permissible – that the place of jurisdiction is the registered office of Gastro topcard .

The product may only be removed from the packaging if it is unsealed. If you wish to return the item, you must notify us. To do so, fill out the return form on our website or use the sample cancellation form below. You can also notify us of your return by email totopcard.
Please note that you must return the items to us within 14 days of notifying us of the return. Processing your return: Once we receive your return, we will inspect the returned item and then begin processing your refund. Your money will be refunded using the payment method you used at the time of purchase, unless you request a different refund. We will pay your refund within 14 days. You are responsible for the return shipping costs. The maximum cost is €29.90.
Non-returnable items : The following product types cannot be returned: Products that have been custom-made according to the customer's instructions. As well as: Catering menus with custom logo finishing featuring the customer's logo/design.
